Un jury a reconnu Donald Trump coupable d’avoir agressé sexuellement le chroniqueur de conseil E. Jean Carroll en 1996 et lui a accordé 5 millions de dollars dans un jugement qui pourrait hanter l’ancien président dans sa campagne pour reconquérir la Maison Blanche. Le verdict a été annoncé devant le tribunal fédéral de New York le premier jour des délibérations du jury le mardi 9 mai 2023.
Les jurés ont rejeté les affirmations de Carroll selon lesquelles elle avait été violée, mais ont jugé Trump responsable de l’avoir agressée sexuellement.
Le juge de district américain Lewis A. Kaplan a lu les instructions sur la loi au jury de neuf personnes avant que le panel ne commence à discuter des accusations d’agression et de diffamation de Carroll peu avant midi.
Abordant les allégations de diffamation découlant d’une déclaration faite par Trump sur les réseaux sociaux en octobre dernier, Kaplan a déclaré que les jurés doivent être guidés par une norme juridique plus élevée : des preuves claires et convaincantes. Il a dit qu’ils devraient convenir qu’il était « très probable » que la déclaration de Trump soit fausse et faite de manière malveillante avec une intention délibérée de blesser ou par haine ou par mauvaise volonté avec un mépris téméraire pour les droits de Carroll.
Par ailleurs, l’ancien président américain a rejeté d’un revers de main l’accusation. « Je pense qu’elle est mentalement malade », déclare Trump à propos de son lanceur d’alerte.
